The court has granted three petitioners permission to lodge their complaint against Kiambaa Constituency Development Funds manager Lorna Muthoni Njoroge before the NGCDF board within seven days.
Justice Byram Ongaya directed the petitioners that if they fail to do so then the matter will be struck out with no orders as to costs.
In the case, Richard Mulwa Musyoka, Richard Nzine, Nicholas Michael and Elizabeth Mumbi petitioned the court to have Lorna Muthoni Njoroge removed from office, saying that she is unfit to serve.
Effectively, Lorna’s fate now hangs in the balance and remains uncertain.
However, when the matter was in court for further directions on Wednesday morning, where the petitioners’ lawyer Shadrack Wambui urged the court to stay the proceedings as they exhaust all the available mechanism.
“We are seeking the court to stay the matter so as to raise the issues with the body responsible …We have exhausted that means we can return ….was a concern that the court had raised that whether they have exhausted other internal mechanisms.” Wambui told the court.
However, the respondents opposed to the application and urged the court to strike out the petition arguing that the petitioners are wasting court’s time.
“Petitioners are taking court for granted because they had said that they had made those attempts…This matter can’t be stayed and therefore we ask the matter to be stuck out with cost to the second respondent,” The court heard.
The judge directed that the matter be mentioned for further directions on June 27, 2024.
In the case, the the four petitioners say that Lorna is allegedly engaging in nepotism.
“She is engaged in acts of nepotism …we have raised the matter before this court …there has not been any action taken against her with relevant authorities.” Documents filed in court read in part.
However, Lorna has filed a preliminary objection saying that the court has no jurisdiction to hear the petition adding that it is premature.
“The application and the petition are mere schemes to perpetrate smear campaigns in an attempt to malign the second respondent name.” The application says.
Further she says that the petitioners have been hired and are representing her estranged husband as indicated in the witness statement filed in court.
