Director of Public Prosecution has opposed bail application by seven suspects charged with murder of former Kabete MP George Muchai, two bodyguards and a driver in 2015.
The DPP through senior counsel Catherine Mwaniki, told trial judge Jame Wakiaga that although bail is a constitutional right for the suspects the circumstances of the case don’t favour their being freed on bond. The suspects have applied to be released on bond saying they are not flight risk.
They told the court they will comply with all conditions given to them by court while out on bond the prosecution on its part said the harsh penalty staring the suspects is an incentive for them to jump bail before determination of the case.
There are two parallel trials before Justice Wakiaga and chief magistrate Francis Andayi over the murder and the violent robbery respectively. The accused persons are Margaret Njeri Wachuiri, Raphael Kimani Gachii alias Butchcher Kimani Anyonyi alias Musti , Stephen Asiliva Lipapo alias Chokore Erick Muyera Isabwa alias chairman, Jane Wanjiru Kamau alias Shiro and Simon Wambugu Gichamba.
The accused have denied murdering Muchai, his bodyguards police constables Samuel Kimathi Kalikia, Samuel Lekakeny Matanta and his driver Stephen Ituu Wambugu in the wee hours of February 7 2015 on Kenyatta Avenue, Nairobi.
Justice Wakiaga adjourned the ruling to September 28, 2018.
