Former Citizen TV journalist Jackie Maribe and her ex-fiancée Jowie Irungu will know their fate next month after the high court postponed judgment delivery of their case on the murder of businesswoman Monica Kimani.
The former anchor and Jowie were charged with the murder of the businesswoman.
The judgment had been earlier on postponed from October six to today after Lady Justice Grace Nzioka was reported to be sick.
The new date which was today failed to happen and the verdict is set to happen in January 26, 2024.
Postponing the ruling today, Justice Nzioka said she is yet to complete going through the exhibits that were submitted to her on Monday this week.
In a virtual submission, the judge told the parties in the case that “three gunny bags” of exhibits were submitted to her and she would need more time to peruse them.
The said exhibits include items such as clothing, and bottles among others.
Irungu, who is the main accused person had pleaded with the judge to deliver the judgment before the Christmas holiday, arguing that it has been a long and agonizing wait for him and his family.
The judgment comes after the trial was completed in July this year after the defence handed their final submissions.
The counsel representing Jowie and Maribe asked the court to acquit them.
They urged that the protection had failed to prove the two are culpable of Killing Monica who was found brutally murdered at her Lamuria gardens apartment.
Counsel Katwa Kigen who is representing Maribe specifically argued that non of the witnesses had incriminated her during the proceedings adding that the case was based on circumstantial evidence.
He said there was no evidence linking her to the murder of Monica and that she was not aware of her existence.
“The case is based on circumstantial evidence; there’s no direct evidence against the second accused person. There was no blood group association between the blood that was found and the accused and there’s no confession that would suggest that she had a hand in the death of Monica.” Kigwen said.
Reacting to the postponement of the ruling Maribe stated that she is tired of the regular postponement by the courts since October.
She said that was being denied justice even though according to her she us not capable.
“It needs to stop. Five years I have respected the court, but also this is too much. This is not Kenya. Justice Grace Nzioka, Justice delayed is justice denied. Stop putting people’s lives in limbo. If I am not capable I am not. I am tired of this.” Maribe stated.
