Five individuals have obtained a court order seeking to stop Nairobi City County Assembly from adopting two controversial reports touching on County revenue use.
The reports were contained in the Assembly’s order of business for Thursday, June 29, 2023, which were adopted in today’s motions moved by the Chairperson of Select Committee on County Finance, Budget and Appropriations and Chairperson Select Committee on Public Accounts.
“It is notified that, this Assembly adopts the 10th Report of the Select Committee on Finance, Budget and Appropriation on the consideration of the revenue and expenditure estimates for the Nairobi City County Government and County Assembly for the FY 2023/24, laid on the table of the Assembly on Tuesday, 27th June, 2023.” Read Orders of the Day in the Second Session of the Third Assembly.
“That, this Assembly adopts the report of the select committee on public accounts on the consideration of the Report of the Auditor General on Alcoholic Drinks Control and Licensing Board for the year ended 30th June 2020, laid on the table of the Assembly on Thursday, 22nd June 2023.”
In the order issued by the High Court of Kenya Milimani and signed by Justice Jairus Ngaah through the Nairobi City Court, Hesbon Mole, Agwena and Jairus Musumba plus three others lodged an Application against Nairobi City County and the Auditor General.
“I have read the Applicants’ application dated 26 June 2023 filed under a certificate of urgency of even date. The application is certified urgent. Leave is granted in terms of prayer 2 (a), (b) and (c) of the summons. The substantive motion to be filed and served within 7 days of the date of this ruling. The respondents to file and serve their response within 7 days of the date of service of the applicants’ motion. The suit shall be mentioned on July 17, 2023 for purposes of taking directions on the manner of its disposal. It is so ordered.” Read Justice Ngaah’s order from Milimani High Court.
