Lagdera Member of Parliament Abdikadir Hussein Mohamed has appealed against the High Court’s decision to nullify his election victory.
In his appeal, Abdikadir wants the Appelate court to set aside the High Court’s judgement and uphold his win in the August 9,2022 general elections.
He argued that the allegations raised were not of such magnitude as to warrant nullification of the election results.
He said that the variance of votes from eight polling stations after scrutiny did not alter the difference between him and Abass Ibrahim Kafow which was a total of 1049 votes in violation of section 83 (1) of the election act.
Abdikadir further said the nullification was done despite all ballot papers being verified with the counterfoils found in the ballot boxes at the point of scrutiny and the judgment was delivered based on assumption and presumptions in violation of the established standard and burden of proof in election petitions.
Abdikadir who ran for the Lagdera parliamentary seat on an Orange Democratic Movement (ODM) party ticket garnered 5,939 against Zeitun’s 4,863 votes.
