Sirisia MP John Waluke appeal 67-year jail term

Sirisia Member of Parliament (MP) John Waluke has made an attempt to appeal his 67-year prison sentence claiming it as severe and unfair.

A three-judge panel consisting of Judges Asike Makhandia, Sankale ole Kantai, and Grace Ngenye has already been constituted to preside over the appeal hearing on Wednesday.

Through his attorney Elisha Zebedee, Waluke requests the Appellate court rule on the question of whether payments made in accordance with court actions resulting from arbitral awards and payments made in accordance with garnishee orders, could warrant a criminal accusation and conviction.

The legislator also requests the three-judge bench rule on the breach of contract damages Erad Supplies received in January 2007 at the arbitration stage with the National Cereals and Produce Board (NCPB).

In court documents, Waluke also requests that the judges decide whether a director of a company in the position he held for which there is no recorded evidence that he was involved in the day-to-day operations of the company or was involved in the transactions, is criminally culpable for a transaction in which he never took part in.

Waluke has asked the Court of Appeal to rule whether the High Court and Magistrates Court had the authority to convict him to serve the sentences on behalf of the organisation.

He now requests that the court sets reasonable bail conditions for him until the appeal is heard and decided.

According to Waluke, despite being granted bail by the appropriate Magistrate and High courts, he has never skipped any court session.

The court files show that Waluke requests that the case be accelerated because he would miss parliamentary sesions, which could result in him losing his position.

The Court of Appeal had denied Waluke’s request to attend the hearing in person but Instead join the meeting online while in jail.
