A Congolese woman today sued Nairobi Women’s Hospital (Adams) for refusing to release her and for being detained for a period of nine months for non-payment of hospital bill amounting to over Sh2.3 million.
Nkosi Mangaribe claims that being detained at the hospital has seen the bill amount escalating by the day.
In an affidavit under certificate of urgency filed High Court, Nkosi states that she is a single mother whose children are fully dependent r and her continued detention at the hospital is a threat to their only source of livelihood.
Nkosi has sued Nairobi women hospital, principal secretary ministry of health and attorney General.
She claims the hospital has refused to execute an agreement to allow her pay the bill in installments as she fends for her children who have been since kicked out of the house.
The applicant seeks for an urgent intervention of the court as her rights and those of her children are being violated by the continued detention by the Hospital.
Nkosi also wants the court to give orders that pending the hearing and determination of case, Nairobi women hospital be ordered to immediately release her from their custody upon execution of an undertaking by her to clear the audited medical bill against her.
In the court papers the applicant states that, she was admitted at the hospital on October 11 last year following a bathroom accident that caused injury to her leg and back. Upon successfultreatment, she was discharged on November 7, 2016.
