Professor Kithure Kindiki has lashed out at Raila Odinga and his supporters for allegedly attempting a coup at the Bomas of Kenya ahead of the presidential results announcement at the Bomas of Kenya.
According to Kithure, a mob of people invaded the dias at the national tallying centre in Bomas and that the matter has not been dealt with to date.
He claims that an attack on democracy was witness as the incident remains unresolved with the perpetrators still out there free and not brought to account for their actions.
“On August 15, 2022 a mob invaded the dais at the national tallying centre in a clear attempt interfere with the powers of IEBC to declare the presidential results following the verification & tallying. Abovementioned activities at the national tallying centre on August 15, 2022 amount to a flagrant attempt to overthrow the constitution of our country, to date this heinous attack on our democracy remains unresolved,” Kindiki argued.
He confirmed that the verification, tallying and declaration of the remaining 27 constituency results happened even though it was not announced verbally.
He accused security agencies for taking sides when they are supposed not to take sides on matters of public interest.
He pre-empts that the presence of the personnel around the national tallying centre facility especially around the plenary of the Independent Electoral and Boundaries Commission (IEBC) to try and fast-track declaration of results was illegal and unconstitutional.
“The events that happened at the Bomas of Kenya on August 15, 2022 mirror what happened in the US in January 2021 when Donald Trump was defeated and supporters… it was Unconstitutional for the National Security Advisory Council (NSAC) to go to Bomas, the commission was within its timeliness of announcing results,” roared Kindiki.
Kindiki asked the court to hold capable the petitioner (Raila) whose supporters, agents and sympathisers were engaged in the alleged chaotic incidents at Bomas on August 5.
He claimed that the petitioner and team should not be near the grounds of a Supreme Court trying to seek reliefs.
Kindiki affirmed that the chaos at Bomas constituted to nothing but an attempt by Raila to establish government unconstitutionally.
He claimed that the events of that day are an attempted but failed coup.
“This court should stop Barabbas and his mob from benefiting from their own maleficence. We pray that all the petitions be struck out with costs, I want to plead and persuade the court to invoke by way of analogy three doctrines of law; doctrines of frustration, the doctrine of necessity and the doctrine of supervening impossibility,”
Kindiki referred to the Attorney General (AG) affidavit as a pseudo petitioner alleging that after listening to the AG, he sounded as if listening to yet another petition.
