Nairobi ODM Senate Aspirant Gabriel Bukachi alias Chapia Chapia suffered a blow today after the Political Parties Dispute tribunal dismissed his case.
Chapia wanted the tribunal to declare him the ODM Nairobi senate flag bearer of ODM in the forth coming general elections.
He had sued ODM and lawyer Edwin Sifuna for purporting to replace his candidature as an ODM nominee to fly Nairobi Senatorial seat.
In its Judgement, the tribunal referred the matter back to the ODM Party saying that it can not micromanage party activities.
The three member tribunal directed ODM to nominate their preferred candidate based on party laws.
In the application, Chapia had complained that he was handed direct nomination to fly the party flag as the senator of Nairobi in early April 2017 and later gazetted by IEBC as an opposed ODM candidate.
He claimed that he mobilised resources, political machineries and was underway with his campaigns to scope the position comes the general elections.
He said the party leader Raila Odinga and other members held talks with him on Mary 3, directing him to surrender the nomination certificate to Sifuna.
“I wastold to hand over the certificate to Edwin Sifuna on the basis that I am less popular to people of Nairobi unlike Sifuna who is likely to attract a big number of following to win the forth coming general elections against jubilee party candidate, ” he claimed in court documents.
Sifuna was interested in the Kanduyi parliamentary seat, but lost in the nominations.
The tribunal dismissed the dispute and referred the matter back to ODM.
