Controversy surrounding the nomination of Kwale ODM senator aspirant Issa Boy has taken a new twist after the Political Parties Disputes Tribunal on Sunday ordered the withdrawal of the certificate pending the hearing determination of a petition.
This was after his opponent aspiring senator Nicholas Zani tabled the matter before the tribunal through his lawyer Sarah Muasya.
“In the instance that a nomination certificate has been issued, it should be withdrawn pending the hearing and determination of the application inter-parties,” read part of the political parties dispute tribunal ruling.
Zani launched the complaint before the party dispute tribunal against ODM party as second respondent and Issa Boy as the first respondent.
In his application Zani want Boy disqualified from vying the Kwale county senatorial bid as a result of the massive election irregularities on his part and any nomination certificate issued to him be withdrawn.
Zani also want ODM be compelled to declare him as the only aspirant in Kwale senatorial seat for ODM party.
Earlier Zani had asked ODM election board to disqualify Issah Boy from the race for entering into the race past deadline.
Issah floored Zani during the ODM nominations held on 22nd last month with 15,307 votes against 4,832 votes.
Zani lodged his petition with the ODM’s National Elections Appeal Tribunal after the nominations citing irregularities and lack of fairness in the exercise.
The board disallowed the appeal but Zani appealed for the review of the ruling before the party dispute tribunal.
