Jubilee Appeals tribunal today declared Charles Njagua Kanyi commonly known as Jaguar the winner of Starehe parliamentary nomination.
Law Society of Kenya Vice-President Faith Waigwa-led appeals tribunal overturned the result by the Returning Officers which declared the incumbent Maina Kamanda the winner and directed the National Election Board to issue Jaguar with the certificate.
“The tribunal hereby overturns the result of the declared by the Returning Officer declaring Kamanda as the winner,”said Waigwa.
Kamanda failed to rebut the evidence adduced before the tribunal noted the tribunal chairperson.
Jaguar had lodged compliants of alteration of his result garnered at tallying center.
“The complaint showed alteration made to the JP3 and 4 forms after the polling and the said benefited the respondent who was declared the winner.
The tribunal further observe there was substantial evidence to show that there were alteration and manipulation of votes,the same does not warrant a scrutiny of vote cast.
The musician appeal was premised on three grounds, which were he won in 25polling stations,JP form 3and 3(d) had vote alternation and fake agents’ signature.
In his defense,Kamanda said there were 27 polling centre and a total of 35polling station as some centre had more than one stream.
According to the legislator,the musician won only in 10 polling stations.
Kamanda further submitted that alteration of votes affected five aspirants with the exclusion of Paul Gichuki.
