The Anti-Corruption Court has fined Nairobi businessman Mukuria Ngamau Sh720,850,182 million or serve a period of 27 years after it found him guilty of defrauding the Youth Development Fund of Sh180 million.
His conviction comes after the Ethics and Anti-Corruption Commission (EACC) received information in 2015 that officials from Youth Enterprise Development Fund conspired with a company known as Quorandum Limited to embezzle public funds amounting to Sh180,900,000.
Milimani Chief Magistrate Douglas Ogoti also ordered that the trading firm compensate the Youth Fund for the loss of Sh180 million.
The court found him guilty of five counts of corruption including conspiracy to commit an economic crime, unlawful acquisition of public property, and falsifying documents.
EACC submitted its report to the Director of Public Prosecution Noordin Haji who concurred with recommendations to charge officials from the Youth Enterprise Development Fund and Quorandum Limited.
“Upon completion of investigations, the EACC submitted its report to the DPP who concurred with recommendations to charge Catherine Namuye Akelo, the Chief Executive Officer at Youth Enterprise Development Fund, Bruce Odhiambo, the Chairman at Youth Enterprise Development Fund, Mukuria Ngamau and Doreen Ng’ang’a, the Directors of Quorandum Limited and Quorandum Limited with various offences,” the EACC said.
In 2016, they were arrested and arraigned before the Nairobi- Milimani Anti-Corruption Court where they entered pleas.
EACC charges against Catherine and Bruce were abated having passed away during the pendency of the case.
In April 2021, the court acquitted Ng’ang’a under section 210 of the Criminal Procedure Code.
The hearing concluded with the prosecution calling a total of 31 witnesses.
