A Mombasa law court has struck out a case of fighting in public, facing two son of slain drug baron Ibrahim Akasha after they were extradited to the United States.
However, the third son Abdulsalam Akasha and businessman Ali Punjani will continue with the trial.
Baktash Akasha, Ibrahim Akasha, Vijaygiri Goswami, Abdulsalam and Punjani were facing charges of engaging in a fight at Rahim Bar Restaurant in Nyali estate on January 1.
Baktash, Ibrahim and Goswami have since been extradited to the US where they are facing charges of drug trafficking before a New York magistrate court.
Principal magistrate Francis Kyambia said that since the three are not in the country and they are already facing charges of drug trafficking in the US and it is not clear they will come back within the jurisdiction of the court soon, the matter cannot proceed.
