The Governor of Kirinyaga Anne Waiguru has sought court protection from property developer Kihingo Village Ltd, which has asked the governor to pay the millions of shillings or vacate the Sh80 million house following a foul-up sale agreement in September 2015.
She evaluates that she paid Sh.40 million in cash for the property, Kitsuri home, and had an agreement with Kenya Commercial Bank (KCB) Group to offer an additional Sh.40 million as mortgage where the morgage agreement was not completed.
Kihingo Village Limited, property developer,denied receiving payment from the Govenor, calling her a tenant and not the owner. They demanded that the governor pay rent for the five years she has been residing in the home or risk asset seizure by Chardor Auctioneers.
Appearing before Justice Obaga last week, the two parties were asked to settle the rent dispute among themselves. The Justice issued temporary orders against the eviction and directed them to come for hearing in February 2021.
Court documents show that she approached KCB on the 22nd of January 2016 for a loan of Sh.40 million and charged the property to the bank.
The governor evaluated that the former Tetu MP Ndungu Gethenji could have adviced Kihingo Village to evict her from the property since he owns it.
“Kihingo Villaged allowed the governor to move in before completing the transaction and she paid Sh.40 million after signing the deal,” the Governor’s lawyer argued.
In the agreement, she said, the company allegedly allowed her to get a financier to pay the balance of the purchase price and agreed to release the documents to the bank immediately after receiving the funds from the lender, to act as security.
Through Gichuki King’ara & Co. Advocates, the company threatened to evict and auction her, saying she cannot stay in the house for free and yet she does not own it.
