The Court of Appeal has upheld the Sh12million compensation awarded to the family of road rage victim Edward Rahedi who died of gunshot wounds on January 26, 2008.
Appellate Judges Wanjiru Karanja, Martha Koome and Festus Azangalala dismissed an appeal lodged by businessman Albert Kubai Mbogori on grounds that the award made by High Court Judge Hatari Waweru on October 14, 2013 was justified.
Violet Rahedi had been awarded Sh12million for loss of dependency, Sh150,000 for loss of expectation of life, Sh100,000 for pai and suffering and Sh61,401 in special damages. The widow had sued the businessman after he was convicted of killing her husband following his shooting on the night of December 1, 2007.
Rahedi was driving along Lang’ata Road in Nairobi when he was shot near the Bomas of Kenya causing him to suffer severe head injuries. He died on January 26, 2008, while undergoing treatment.
Mbogori was charged with murder but was eventually found guilty of manslaughter and sentenced to serve 14 months in prison. Upon conviction, the widow sued him for negligently firing his firearm and causing the death of her husband.
