Activist Okiya Omtatah has filed a petition seeking an order to stop the on-going exercise of constituting National Government Constituencies Development Fund (N.G.C.D.F) committees until a properly constituted board is appointed.
Omtatah claims that the board is irregularly managed by a board of four directors instead of five as required by the N.G.C.D.F Act thus lacking the required quorum to conduct business.
In the petition filed at the Milimani Law Courts, Omtatah now wants the court to issue a temporary order of injunction restraining the respondents and their agents from forwarding any nominated Members of N.G.C.D.F committee to the N.G.C.D.F. Board for appointment through gazette notice.
Omtatah further seeks that the services of N.G.C.D.F Chief Executive Officer(C.E.O), Yusuf Mbuno be terminated immediately and his terminal benefits provided in full since his six years tenure in office expired 0n 1st September 2017 hence lacking capacity under the law to order the recruitment of the C.D.F committees in the 290 constituencies.
Omtatah also wants court to compel the newly constituted Board to run the affairs of the N.G.C.D.F according to the law, including the recruitment of permanent staff.
He argues that the law requires that all the 290 C.D.F committees be in place within 60 days of the first sitting of the new parliament and therefore the selection panels in each constituencies cannot be set up as there is no Board to do so.
