A Nakuru businessman has petitioned the Judicial Service Commission (JSC) demanding removal of High Court judge Jackson Ndegwa accusing him of bias and gross misconduct over the manner he handled a land case.
Jackson Ndegwa who had filed a case in court was seeking to have Justice Janet Mulwa disqualify herself from the matter citing bias and favoritism from the judicial staff in presiding with the matter.
In his petition to the JCS, Ndegwa has sought the high court judge’s removal from the bench, after she shelved his matter during a mention date of the case after his lawyer failed to appear in court to pick a hearing date.
“My case was dismissed on a mention date because my lawyer was not present and the judge accused us of trying to derail the matter,” Read part of the petition.
He further requested that the Judicial Service Commission be pleased to initiate the necessary procedures in removal of the judge after she showed ‘unfair judicial practice’ in the suit where he had sued Housing Corporation of Kenya and the land district registrar over illegal auction of his land despite a court order.
