Court of Appeal has upheld a seven year sentence handed to two police officers accused of murdering 14 year- old-girl Kwekwe Mwandaza in 2014.
Appellate judge Asike Makhandia said the court could not interfere with the judgment issued by judge Martin Muya on February 10, 2016.
Inspector Veronica Gitahi who was the then Kinango Directorate of Criminal Investigations boss and constable Issa Mzee were jailed for seven years after they were found guilty of committing the offence on August 22, 2014.
They had been charged with the offence of murder but the charge was reduced to manslaughter after the judge found that the two “had no pre-meditated intention of killing the minor”.
The minor was shot in the head and on the chest during a botched operation meant to arrest his alleged criminal uncle.
Justices Asike Makhandia, William Ouko and Kathurima Inoti who heard the appeal filed by the two officers dismissed it saying the killing of the minor was contrary to the National Police Service Act.
